Predictive
accuracy
Most of our services
reports a
CONFIDENCE
score. This score
represents the
average measured
statistical accuracy
of the classifier.
For example, 0.8
means 80% or 8/10
correct predictions
observed in our
tests. Our services
improve continually,
but we cannot be
held responsible for
individual mistakes,
such as the age or
gender of a document
being predicted
incorrectly. Make
sure you understand
what is contained in
the texts you
analyze, or contact
us to help
you out.
Refunds When
you sign up for a
paid subscription,
your credit card is
instantly charged
for the first month.
We do not offer
refunds, but you are
allowed to downgrade
your subscription
back to the free
tier at any time. Contact
us if you
want your account
completely
removed.
Copyright You
may integrate our
services in your own
product, for example
as part of a social
media monitoring
app. You may not
attempt to reverse
engineer the
technology to create
a competitive
product, or sell
(rent, sublicense,
distribute, …)
any of our services.

TEXTGAIN BV
(we, us, our)
operates
textgain.com (our
services). By using
our services, you
agree to these
terms. If you do not
agree to the terms,
do not use our
services.
DATA PRIVACY
Some of our services
can be used to
predict personal
information of
private individuals.
Be advised that the
collection, misuse
or disclosure of
such data may be
prohibited by your
region’s data
protection
laws.
SUBSCRIPTION
Our paid
subscriptions are
billed on a monthly
basis in advance.
Your subscription
will automatically
renew each month,
unless you downgrade
your account or have
your account
removed. You must
provide a valid
credit card and
accurate billing
information, and by
doing so, you
authorize us to
charge subscription
fees incurred
through your
account. We will
issue an electronic
invoice should
automatic billing
fail.
SUBSCRIPTION
FEE We may
change the
subscription fee. We
will provide a
reasonable prior
notice to give you
the opportunity to
cancel your account
before the change
becomes effective.
If you continue to
use our services,
you agree to pay the
new subscription
fee. Subscription
fees are
non-refundable
except when required
by law.
ACCOUNT We
may cancel your
account if you do
not provide
accurate, complete
information, or if
you use the name of
another person,
entity, or trademark
without
authorization. You
agree not to share
your API key or
account password.
You are responsible
for safeguarding
your password and
for any actions
under your account.
You must notify us
immediately of any
unauthorized use of
your account or
security
breach.
ACCOUNT
TERMINATION
We may cancel your
account without
prior notice or
liability, for any
reason, including
without limitation
if you breach our
terms. Your right to
use our services
will cease
immediately. You can
cancel your account
at any time.
THIRD PARTY
LIBRARIES
Some of our
pipelines use code
developed by
Explosion AI and are
used according to
their respective
licenses.
COPYRIGHT
With the exception
of the
aforementioned third
party libraries,
TEXTGAIN BV is the
exclusive owner of
the services and its
original content,
features and
functionality. The
services are
protected by
copyright,
trademark, and other
laws in Belgium and
foreign countries.
You may not use our
trademarks or trade
dress with any
product or service
without our prior
written consent. You
may not reproduce,
reverse engineer,
decompile,
dissassemble or
otherwise attempt to
derive the source
code, or create
derivative works of
our services
(reverse
engineering). If you
believe that reverse
engineering
constitues fair use,
you must first
request such
information from
us.
LIMITATION OF
LIABILITY In
no event will
TEXTGAIN BV be
liable for your loss
of revenues or
indirect,
incidental, special,
consequential,
exemplary or
punitive damages,
resulting from your
use or inability to
use the services,
even if advised of
the possibility of
such damages, and
even if a remedy is
found to have
failed.
DISCLAIMER
Your use of the
services is at your
sole risk. The
services are
provided on an “AS
IS” and “AS
AVAILABLE” basis,
without warranties
of any kind, express
or implied,
including but not
limited to, implied
warranties of
merchantability,
fitness for a
particular purpose,
title,
non-infringement, or
course of
performance. We do
not warrant that the
services are
accurate, complete,
reliable, current,
or error-free.
GOVERNING LAW
The terms shall be
governed and
construed in
accordance with the
laws of Belgium,
without regard to
its conflict of law
provisions. If any
provision of the
terms is invalid, or
unenforceable by a
court, the remaining
provisions of the
terms remain in
effect. Our failure
to enforce any
provision of the
terms does not
constitute a waiver
of that provision or
of any other
provision.
CHANGES These
terms are effective
from October 2,
2018, and supersede
any prior terms.
